AILA has learned through the National Network to End Violence Against Immigrant Women and the National Immigration Project that the USCIS has sent an e-mail instructing district offices to hold in abeyance all applications for adjustment of status for VAWA self-petitioners who entered without inspection. We have not been provided a copy of the e-mail. We understand that district offices have been instructed to HOLD cases, not DENY cases, pending further guidance from USCIS Headquarters. Prior to this e-mail, the district offices have been handling these cases differently. Some districts have been adjudicating VAWA EWI adjustments, while others have found that VAWA applicants who entered without inspection or admission remain inadmissible and cannot adjust under the VAWA provisions. AILA will provide updates as new information is learned.
